    I believe that the Good Fortune Market's HVAC and refrigeration units on their recently completed addition are again in violation of MA DEP Noise Control Regulation 310 CMR 7.10. Noise from the units has been steadily increasing. The market has still not taken full corrective action and should install noise shielding on their roof to mitigate this noise. Such installation of noise shielding is common practice for commercial buildings of this type and would be considered best management practice for noise mitigation.

    Besides the public nuisance created be the smell from the dumpster at the Good Fortune Market, affecting the homes nearest the market, they consistently swap out the dumpster every Monday and Friday around 5:30am. This is a violation of Quincy ordinances that specify no trash removal prior to 7:00am. Removal of the dumpster is a rather noisy process. We all have young toddlers near here that are being woken up by this noise. The attached picture is hard to make out, but the lights are from the trash removal truck moving the dumpster out.

Very noisy to the point of waking up my small children. Something needs to be done not only about this time of pickup but location of the dumpster as well. It is too close to a residential neighborhood.

    As the weather warms a new issue is developing with the Good Fortune Market at 230 Quincy Ave, considering their chosen location for their dumpster. They have placed it on the property line abutting my back yard. The oder is so strong it is creating a public nuisance as it is directly affecting not only myself but my neighbors as well. I would like the City to follow its own bylaws in this situation and require Good Fortune Market to relocate the dumpster in a location that mitigates this air quality impact. The cited bylaw is as follows:

    "8.12.040 - Dumpsters—Requirements.
    A.
    Location. Each dumpster shall be located at a distance from the lot line so as not to interfere with the safety of or obstruct the curb and sidewalk, or the convenience or health of abutters and the general public, or obstruct the view of flowing traffic. The location of dumpsters shall be subject to approval of the health commissioner and building department."

    I would like to be able to allow my young children to play in their backyard without the strong oder of rotting organic materials. I believe this issue qualifies as direct interference with the use and quiet enjoyment of my property, as well as my neighbors'.

    I believe that the Good Fortune Market's HVAC units on their recently completed addition are in violation of MA DEP Noise Control Regulation 310 CMR 7.10 and so far the City of Quincy has done nothing to look into or otherwise investigate. In accordance to 310 CMR 7.52 Enforcement Provisions:

    "Any police department, fire department, board of health officials, or building inspector or his designee acting within his jurisdictional area is hereby authorized by the DEP to enforce, as provided in M.G.L. c. 111, S 142B, any regulation in which specific reference to 310 CMR 7.52 is cited."

    Not sure what my next steps are but I will not stop until this issue is addressed.

    HVAC units on the roof of Good Fortune Market's new extension are excessively noisy. Noise does not appear to be mitigated at all. Constant drone can be heard throughout the house! Nuisance to residential units nearby. Can anything be done about this? Such an issue was not addressed during the permitting phase. Can anything be done?
